Terms for business customers.
These terms cover the YachtMotion app and the web desk. The website yachtmotion.com has its own terms.
1 · Who these terms are with
These terms are a contract between you and Digital Delivery GmbH, Rigiweg 21A, 6343 Holzhäusern ZG, Switzerland. Registered seat: Risch, canton of Zug. Company number (UID): CHE-178.105.720. In these terms, "we" means Digital Delivery GmbH. YachtMotion is our product.
When your business buys films, our business terms apply as well. They set out films, prices, payment, liability, and law and courts. YachtMotion is for businesses. If you use it for purposes outside your trade or profession, the mandatory consumer protection law of your country of residence still applies where it cannot be waived.
2 · What YachtMotion does
YachtMotion turns the photographs and clips you supply into a short film. The film is the unit of the service. You pay in films, as clause 2 of the business terms says. We show the price where you buy, before you confirm. These terms state no price.
3 · Your photographs and clips
Before a film is built, you declare your right to use the photographs and clips it uses. Our rights terms stand behind that declaration. They cover four things: indemnification, prohibited sources, producing proof on request, and takedown.
5 · Where a business's inquiries go
If a film's public page offers an inquiry form, buyers can send an inquiry through it, if you turn that on for the film. A business chooses one address that receives its inquiries. It confirms that address through a link we mail to it. Until it confirms one, an inquiry goes to the person who started the film's published run. That holds only while the person still belongs to the business. For a film in your own account, inquiries go to you. Our privacy policy says what an inquiry holds and who sees it.
6 · The Content Credentials in a film
A film with anything made by AI in it carries Content Credentials. This is a signed record inside the file. It says the film is a composite: your own material together with material an AI model made. That material may be generated scenes, a generated voice or generated music. The record lists where in the film each generated scene sits. No picture and no sound changes because of it. A platform can read it and show its own label.
7 · Law and courts
Swiss law applies to these terms, except where mandatory law says otherwise. The courts at our registered seat decide any dispute, except where mandatory law says otherwise. This is the same rule as clause 13 of the business terms.
